Seller terms and conditions

1. About these terms

These terms apply to every person or business that sells on iTach Market ("the Marketplace"). By ticking the box when you register, or by continuing to sell after we update the terms, you agree to them. If you do not agree, do not register.

2. Registration and subscription

  • Sellers pay a subscription to keep their shop live. Individual sellers pay KES 100 per period; registered companies pay KES 1,000 per period. A period is 30 days.
  • Your first payment is due when you register and covers your first period. We send an invoice before each following period ends.
  • If a subscription is not paid, your offers stay hidden from customers after a grace period of 5 days. Orders already paid for must still be fulfilled. Paying an invoice restores your offers straight away.
  • The subscription is not refundable once a period has started. We may change the amounts with notice; the amount shown on your billing page is the amount that applies.
  • To register as a company you must give a valid business registration number. We may ask for documents to verify it.

3. Sales commission

  • On every completed sale the Marketplace keeps a commission of: 5%, calculated on the value of the goods in each order (excluding delivery). The rate that applies is shown on your billing page and on every order.
  • The commission is deducted from the amount we settle to you. If an order is refunded, the commission on it is reversed.
  • Buyers may also pay a service fee to the Marketplace (currently: no percentage fee). That fee belongs to the Marketplace and is not part of your sale.

4. Your listings

  • You must own or be authorised to sell everything you list, and describe it accurately: correct product, size or specification, brand, price and stock.
  • Prices you list are the prices customers pay. Keep prices and stock up to date; you may use bulk upload, the price template or the POS/ERP API to do so.
  • Listings must match the shared catalogue. If your product is already in the catalogue you list against the existing entry so customers can compare like with like. Duplicate, misleading or counterfeit listings will be removed.
  • Photos you upload must be your own or used with permission.
  • Prohibited goods (illegal, counterfeit, stolen, unsafe, or restricted by Kenyan law) may not be listed.

5. Orders, delivery and payment

  • When a customer pays, you must prepare the order promptly and hand it over for delivery or pickup. Delivery may be by you or by the Marketplace's drivers, depending on your settings.
  • Customers may choose pickup instead of delivery; in that case no delivery fee is charged.
  • Customer payments are collected by the Marketplace. Your earnings become available once the order is delivered and are settled to your payout number.

6. Money-back guarantee

If an order is not delivered within 7 days of payment, the customer may claim an automatic refund. The refund is taken from the seller's earnings on that order and the order is cancelled. Please deliver on time and keep customers informed.

7. Refunds and disputes

You must refund goods that are not delivered, are not as described or are faulty, following the Consumer Protection Act, 2012. Where you fail to do so we may refund the customer and recover the amount from your earnings.

8. Adverts

  • Sellers may buy adverts from KES 5,000 a day (the price per placement is shown when you book). Adverts are prepaid for the days you choose, are reviewed by us before they run, and are always shown as "Sponsored".
  • If we do not approve an advert, the payment is refunded in full. Once an advert has started it is not refundable, including paused days.
  • Adverts must be truthful, must not promote prohibited goods and must not copy other people's brands or pictures. Adverts do not change how products, brands or sellers are ranked or recommended.

9. Your location

You must give the correct area your shop is in. It is used to show customers how far you are from them and to rank nearby sellers first. Ratings of your shop come only from customers who received an order from you and cannot be removed unless they break the rules.

10. Suspension

We may hide offers, suspend or close a shop that breaks these terms, receives repeated valid complaints, or fails to pay fees. We will tell you why.

11. Personal data

We handle personal data in line with the Data Protection Act, 2019. You may use customers' details only to fulfil their orders.

12. Changes and contact
